Acceptance of Terms
By accessing or using the Site (including submitting any application through the Site), you agree to be bound by these Terms and any policies or documents referenced herein. If you do not agree, do not use the site. These Terms apply to all users, visitors, and others who access the site.

Description of Service (We are a Connector)
ASBNow is not a lender, does not make credit decisions, and does not charge the user any fees directly. Our Service matches or forwards your application and information to a network of third-party lenders and partners so those lenders can evaluate your eligibility for loan offers. Any loan, financing, or credit product is subject to approval by the third-party lender; terms and conditions, including interest rates and fees, are determined by those lenders.
User Eligibility and Requirements
To use the Services you represent and warrant that:
- You are at least 18 years old (or the age of majority in your jurisdiction).
- You have the legal capacity and authority to enter this Agreement.
- All information you provide is true, accurate, complete, and up to date.
- You will maintain the security of any login, password, or account information and are responsible for all activity under your account.
- You will not use the Site for illegal purposes or in a manner that violates these Terms.
If you are applying for a loan, individual lenders may have additional eligibility rules (residency, income, credit history, licensing rules) and may refuse or cancel offers at their discretion.
TCPA Consent
By submitting any phone number or mobile number to ASBNow, you expressly consent to receive calls and text messages (including automated or prerecorded messages) from us and our lender partners and service providers for marketing, transactional, or servicing purposes, even if your number is listed on a state or national Do-Not-Call registry, to the extent permitted by applicable law. This consent includes calls or texts made using an automatic telephone dialing system or an artificial or prerecorded voice. You understand that consenting is not required to obtain services. The nature and scope of consent is subject to applicable law and regulatory guidance under the Telephone Consumer Protection Act (TCPA) and related FCC rules; we follow applicable TCPA requirements and retain records of consent as required.
Accuracy of Information
You agree to provide accurate and complete information. You authorize us and our partners to verify your information through third parties and to obtain consumer reports or other verification where permitted by law to evaluate your eligibility for offers. You are responsible for any loss or damage that results from providing false or misleading information.
Third-Party Links & Lenders
The Site may contain links to third-party websites or resources and, most importantly, forwards your application and data to third-party lenders. We do not control, endorse, or guarantee the content, privacy practices, or actions of third parties. Each lender or third-party service provider has its own terms, disclosures, and privacy practices; you should review those terms before providing additional information. We are not responsible for the privacy or security practices of third-party lenders and accept no liability for their actions.
User Conduct & Prohibited Uses
You agree not to:
- Use the Site to impersonate another person, falsify information, or otherwise misrepresent identity.
- Interfere with or disrupt the Site or servers, or attempt to access restricted areas.
- Use automated tools to scrape or harvest data from the Site.
- Use the Site for any unlawful purpose.
We may suspend or terminate your access for violations of these Terms.
DISCLAIMER OF WARRANTIES
THE SITE AND SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS. EXCEPT AS EXPRESSLY PROVIDED HEREIN, ASBNow DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT GUARANTEE THAT YOU WILL RECEIVE A LOAN, A PARTICULAR LOAN AMOUNT, OR SPECIFIC TERMS OR RATES FROM ANY LENDER. ALL LOAN OFFERS ARE SUBJECT TO APPROVAL BY THE LENDER.
LIMITATION OF LIABILITY
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ASBNow, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR AGGREGATE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF BUSINESS, LOSS OF USE, LOSS OF DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE SITE, OR ANY THIRD-PARTY OFFER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF US$100, OR THE AMOUNT YOU ACTUALLY PAID TO ASBNow FOR THE SERVICES IN 6 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. THIS LIMITATION SHALL APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY, OR OTHERWISE.
Indemnification
You agree to indemnify, defend and hold harmless ASBNow and its affiliates, and their officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: your use of the Site; your violation of these Terms; your breach of any representation or warranty; or any claim that your content or use of the Site infringes or misappropriates the rights of a third party.
Fees and Payments
ASBNow does not charge users a fee for submitting an application or using the basic matching Service. If a third-party lender or partner charges a fee, that will be disclosed by that lender in accordance with the lender’s own terms. You are responsible for any costs related to communications (for example, your mobile carrier’s message or data fees).
Privacy & Data Practices
Our use of personal information is governed by our Privacy Policy. By using the Site you consent to our collection, use, and disclosure of information as described in the Privacy Policy. We share information with lender partners as necessary to obtain loan offers; those partners have their own privacy practices. (See our Privacy Policy for more detail.)
Arbitration Agreement & Class Action Waiver
Except where prohibited by law, you and ASBNow agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site, or the Services, including the interpretation, breach, termination or validity thereof, shall be resolved by binding arbitration on an individual basis before a neutral arbitrator and not in court. You understand and agree that by entering this agreement you and ASBNow are each waiting for the right to a trial by jury or to participate in a class, collective, or representative actions.
- Arbitration Rules: The arbitration will be administered by a neutral arbitration provider selected by ASBNow (e.g., AAA or JAMS) under that provider’s rules then in effect, except as modified by these Terms. The arbitrator has the authority to award the same damages and relief as a court.
- Small Claims Court: Either party may pursue a claim in small claims court for disputes within that court’s jurisdiction.
- Opt-out: If you do not wish to be bound by this arbitration provision, you may opt out by sending a written notice to ASBNow within 30 days of first agreeing to these Terms. The notice must include your name, address, email, and a clear statement that you “opt out” of arbitration.
- Severability: If the class action waiver is found unenforceable, the remainder of this arbitration provision will remain in effect.

Intellectual Property
All content on the Site (text, graphics, logos, images, audio, video, software) is the property of ASBNow or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view, copy, and print content for your personal, non-commercial use only. Any other use requires our prior written permission.
Termination; Suspension
We may suspend or terminate your access to the Site at any time for any reason, including suspected fraud, abuse, or violation of these Terms. Upon termination, your right to use the Site ceases immediately. Sections that by their nature should survive termination (e.g., DISCLAIMER, LIMITATION OF LIABILITY, Indemnification, Arbitration) will survive.
Modification of Terms
We may modify these Terms at any time by posting a revised version on the Site. The revised Terms will be effective as of the “Last Updated” date posted above. Your continued use of the Site after posting of changes constitutes acceptance of those changes. If we make material changes, we will take commercially reasonable steps to notify users (for example, by email or via a conspicuous notice on the Site).
Notices and Electronic Consent
You agree that communications from ASBNow may be in electronic form (email, SMS, or notices posted on the Site). Electronic communications satisfy any legal requirement that such communications be in writing. You also consent to electronic signatures and records where permitted.
Governing Law and Venue
These Terms and any dispute shall be governed by the laws of the state in which ASBNow is incorporated or has its principal place of business, excluding that state’s conflict-of-law rules. The arbitrator will apply controlling law consistent with the Federal Arbitration Act and applicable state statutes.
International Users
If you access the Site from outside the United States, you are responsible for compliance with local laws. By using the Site, you acknowledge that information you provide may be transferred to, stored, and processed in the United States and other jurisdictions where our service providers operate.
Miscellaneous Provisions
- Assignment: You may not assign your rights or delegate your duties under these Terms without our prior written consent. ASBNow may assign its rights and obligations at any time.
- Entire Agreement: These Terms (including referenced policies) constitute the entire agreement between you and ASBNow with respect to the Site.
- Severability: If any provision is invalid or unenforceable, it will be modified to the extent necessary to make it enforceable; the remaining provisions will remain in full force.
- Waiver: Failure to enforce any right is not a waiver of that right.
